Estos términos regulan el uso de Wazenda, una plataforma de mensajería para empresas desarrollada y operada por dotark (dot-ark.com), que opera sobre WhatsApp, incluida la WhatsApp Business Platform (Cloud API) de Meta. Al crear una cuenta o usar el servicio aceptas estos términos.

1. El servicio

Wazenda permite conectar números de WhatsApp, enviar y recibir mensajes, gestionar campañas, plantillas y automatizaciones, y consumir estas funciones mediante una API. El servicio se presta "tal cual" y puede evolucionar con el tiempo.

2. Cuentas y acceso

• Debes proporcionar información veraz al registrarte y mantener tus credenciales y claves de API en secreto.
• Eres responsable de toda la actividad realizada desde tu cuenta y tus claves de API.
• Podemos suspender cuentas que incumplan estos términos o las políticas de WhatsApp/Meta.

3. Uso aceptable

• Solo puedes enviar mensajes a contactos que hayan dado su consentimiento para recibirlos (opt-in).
• Está prohibido el spam, el acoso, el contenido ilegal, fraudulento o engañoso, y cualquier uso que infrinja las políticas de WhatsApp Business o los términos de Meta.
• No puedes intentar eludir los límites de uso, la autenticación ni las medidas de seguridad de la plataforma.

4. Relación con Meta y WhatsApp

Wazenda no está afiliada a Meta Platforms, Inc. El uso de WhatsApp a través de la plataforma está sujeto además a los términos y políticas de Meta y WhatsApp. Meta puede restringir o suspender cuentas de WhatsApp Business por incumplimiento de sus políticas, algo que está fuera de nuestro control.

5. Datos personales

El tratamiento de datos personales se rige por nuestra Política de Privacidad. Como cliente, eres responsable del tratamiento de los datos de tus contactos conforme a la normativa aplicable.

6. Disponibilidad y limitación de responsabilidad

Procuramos mantener el servicio disponible de forma continua, pero no garantizamos un funcionamiento ininterrumpido ni libre de errores, en particular cuando dependa de servicios de terceros (Meta/WhatsApp, infraestructura de hosting). En la máxima medida permitida por la ley, nuestra responsabilidad total se limita a los importes pagados por el servicio en los tres meses anteriores al hecho que origine la reclamación.

7. Terminación

Puedes dejar de usar el servicio y solicitar la eliminación de tu cuenta en cualquier momento. Podemos terminar o suspender el acceso en caso de incumplimiento de estos términos, notificándotelo cuando sea razonablemente posible.

8. Cambios

Podemos modificar estos términos. Publicaremos la versión vigente en esta página y, si el cambio es sustancial, lo comunicaremos a los usuarios registrados.

These terms govern the use of Wazenda, a business messaging platform developed and operated by dotark (dot-ark.com), which operates on top of WhatsApp, including Meta's WhatsApp Business Platform (Cloud API). By creating an account or using the service you accept these terms.

1. The service

Wazenda lets you connect WhatsApp numbers, send and receive messages, manage campaigns, templates and automations, and consume these features through an API. The service is provided "as is" and may evolve over time.

2. Accounts and access

• You must provide accurate information when registering and keep your credentials and API keys secret.
• You are responsible for all activity carried out from your account and your API keys.
• We may suspend accounts that violate these terms or the WhatsApp/Meta policies.

3. Acceptable use

• You may only send messages to contacts who have given their consent to receive them (opt-in).
• Spam, harassment, illegal, fraudulent or misleading content, and any use that violates the WhatsApp Business policies or Meta's terms is prohibited.
• You may not attempt to bypass the platform's usage limits, authentication or security measures.

4. Relationship with Meta and WhatsApp

Wazenda is not affiliated with Meta Platforms, Inc. Use of WhatsApp through the platform is additionally subject to Meta's and WhatsApp's terms and policies. Meta may restrict or suspend WhatsApp Business accounts for violating its policies, which is outside of our control.

5. Personal data

The processing of personal data is governed by our Privacy Policy. As a customer, you are responsible for the processing of your contacts' data in accordance with applicable regulations.

6. Availability and limitation of liability

We strive to keep the service continuously available, but we do not guarantee uninterrupted or error-free operation, particularly where it depends on third-party services (Meta/WhatsApp, hosting infrastructure). To the maximum extent permitted by law, our total liability is limited to the amounts paid for the service in the three months prior to the event giving rise to the claim.

7. Termination

You may stop using the service and request the deletion of your account at any time. We may terminate or suspend access in the event of a breach of these terms, notifying you where reasonably possible.

8. Changes

We may modify these terms. We will publish the current version on this page and, if the change is material, we will notify registered users.
